NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
ELIGIBILITY: The “Scotties Pure Escape” Sweepstakes (the “Sweepstakes”)
is open only to legal residents of the 50 United States and the District of Columbia, who
have reached the age of majority in the state or district in which he/she is residing at
the time of entry into the Sweepstakes. Void outside of the 50 United States and the
District of Columbia and where prohibited, taxed or restricted by law. Employees,
officers and directors (including immediate family members and members of the same
household of such persons, including common law spouses) of Irving Consumer Products,
Inc. (the “Sponsor”), its respective affiliates (including, without limitation, its
parent, sister and subsidiary companies), agents, participating stores, advertising
or promotional agencies, independent judging agency (“Administrator”), suppliers of
prizes (“Prizes”) and/or materials or services related to the Sweepstakes are not
eligible to enter the Sweepstakes.
PROMOTION PERIOD: The Sweepstakes starts on May 5, 2008 at 12:01 A.M.
Eastern Time (“ET”) and ends at 11:59 P.M. ET on August 4, 2008 (“Promotion Period”) after
which time the Sweepstakes will be closed and no further entries will be accepted.
HOW TO ENTER: UPC Codes can be found on specially-marked packages
of Scotties Facial Tissues, while supplies last. To enter, go to
www.purescotties.com
(the “Website”) follow the online entry instructions and enter your UPC Code and
complete the official online entry form with your complete name, address, city,
state, zip code, daytime phone number (optional) and email address; and, click
“Submit,” and you will be automatically entered into the Sweepstakes; OR mail
a 3” x 5” card/paper with your complete name, address, city, state, zip code,
daytime telephone number (optional), and email address (optional) to Scotties
Pure Escape, Game Code Request, Dept. A, P.O. Box 72939, Rockford, MN 55572.
All entries must be received by August 4, 2008 (the “Sweepstakes Closing Date”).
ENTRIES: A person may use only one (1) email address to
participate in the Sweepstakes. Limit one entry per UPC code per week per
person/household during the Promotion Period (each a “Weekly Entry Pool”).
Entries for each Weekly Entry Pool must be received by no later than 11:59 p.m.
ET on that Weekly Entry Pool’s deadline date set forth in the Drawing and Prize
Schedule below to be eligible for that Weekly Entry Pool’s drawing and
postmarked by the Sweepstakes Closing Date and received by 8/8/08 to be
entered into the Grand Prize drawing. Sponsor’s computer will be the
official time clock for online entries. Any person, who is found to have
entered more than once per Weekly Entry Pool, or with more than one (1)
e-mail address, will be disqualified and all entries received from such
person during the Weekly Entry Pool will be disqualified. Proof of
transmission (screenshots or captures, etc.) does not constitute proof of
delivery. Entries generated by script, macro, robotic, programmed, or any
other automated means are prohibited and will be disqualified. The Sponsor
will not be responsible for late, lost, illegible, falsified, damaged,
misdirected, mutilated, garbled or incomplete entries, which will be void.
All entries become the property of the Sponsor upon receipt and none will
be returned.
PRIZES: One (1) Grand Prize:
A 7-day/6night trip for four (4) to Hawaii in a PURE Allergy Friendly Suite.
Trip includes: Round-trip coach airfare for winner and three (3) guests from
major airport nearest winner’s residence to Oahu, HI; 6-nights hotel
accommodations (one room, quad occupancy) at the JW Marriot Ihilani Resort
and Spa in a PURE Allergy Friendly Suite; seven (7) days of breakfast for
four (4) at the Resort; a $100 meal voucher valid at the Resort; one (1)
50-minute Spa treatment at the Resort; FREE parking at the Resort, awarded
in the form of parking vouchers; and $500 in spending money, awarded in the
form of a check. The approximate retail value (“ARV”) is $16,800.00. The
actual value of the Grand Prize will depend upon winner’s point of
arrival/departure. Any difference between the ARV and the actual retail
value will not be awarded. All travel-related expenses not set forth herein,
including ground transportation, gratuities and incidental hotel expenses
are the sole responsibility of Grand Prize Winner. Blackout dates and other
travel restrictions may apply. Trip arrangements must be made before
December 31, 2009 and completed by June 1, 2010, or Grand Prize will
be forfeited.
One thousand five hundred (1,500) First Prizes: One-hundred
fifteen (115) First Prizes will be awarded each week for the first 12 Weekly Entry
Pools, and one-hundred twenty (120) First Prizes will be awarded in the 13th Weekly
Entry Pool: A First Prize will be one (1) of the following as specified by
Sponsor: (1) A USB Ionizer/Air Refresher; OR (2) A Homedics Travel Pillow;
OR (3) A Travel Kit. ARV: $25.00 each. Total ARV of all Prizes combined
is $54,300.00.
All Prizes are non-transferable. No substitutions or cash redemptions of
Prizes allowed by First Prize winners or Grand Prize winner (collectively
“Winners”), but Sponsor reserves the right, in its sole and absolute
discretion, and for any reason whatsoever, to substitute for any Prize or
component of any Prize, a substitute prize of equal or greater value without
liability. Prizes consist only of items expressly specified in these Official
Rules. Any item, cost or expense not specifically listed, as part of the
Prize(s) is the sole responsibility of the Winner. No more than the
advertised number of Prize(s) will be awarded. All taxes on prizes are
the sole responsibility of the Winners. A 1099 tax form will be issued
to the Grand Prize Winner.
RANDOM DRAWINGS: Weekly Draws: One-hundred fifteen (115)
weekly First Prize winners will be selected in random drawings for each of the
first twelve (12) Weekly Entry Pools, and one-hundred twenty (120) First Prize
winners will be selected in a random drawing for the thirteenth (13) Weekly
Entry Pool, to be held per the Drawing and Prize Schedule from among all
eligible entries received for each Weekly Entry Pool’s drawing period by
Administrator. Odds of winning depend on the number of eligible entries
received for each Weekly Entry Pool. First Prize winners will automatically
receive their First Prize automatically via courier or US Mail (at Sponsor’s
discretion) within approximately four (4) to six (6) weeks after the random
drawing, to the address provided at the time of entry. Limit one First Prize
per Weekly Entry Pool per person/household. If any First Prize is returned
as undeliverable, the Prize will be forfeited and an alternate First Prize
winner will be selected from all remaining eligible entries. Non-winning
entries for any Weekly Entry Pool will NOT be carried over to subsequent
Weekly Entry Pools, but WILL be carried over to the Grand Prize Random
Drawing.
Grand Prize Random Drawing: A Grand Prize random drawing
will be conducted on or about 8/11/2008 from among all eligible entries
received (including First Prize winners) throughout the Promotion Period.
Odds of winning the Grand Prize depend on the number of eligible entries
received throughout the Promotion Period. Administrator will notify the
potential Grand Prize Winner by telephone, postal mail, and/or express
mail on or about 8/12/2008.

PRIZE FORM: Prior to being declared the Grand Prize Winner and
receiving the Grand Prize, the potential Grand Prize Winner must complete and return
the Sponsor’s Affidavit of Eligibility and Release of Liability/Publicity Release
(the “Prize Form”) within 14 days of notification. Failure to comply with this
requirement for any reason or return of Prize notification as undeliverable will
result in forfeiture of the Grand Prize and an alternate winner may be selected.
Guests (or guest’s parent/legal guardian if any guest is deemed in a minor in the
state of his/her residence) of Grand Prize Winner must sign and return a Release
of Liability/Publicity Release prior to issuance of tickets. If any guest is deemed
a minor in the state of his/her residence, Grand Prize Winner must be his/her parent
or legal guardian, or he/she must be accompanied by his/her parent/legal guardian
who will be counted as one of the three (3) guests. All travelers must travel on
the same itinerary and must possess required travel documents (i.e. photo i.d., etc.)
prior to departure. Travel must be completed on the dates specified by Sponsor, which
are subject to change, or prize will be forfeited. By completing and returning the
Prize Form, and accepting the Grand Prize, the Grand Prize Winner confirms compliance
with the Official Rules, acknowledges that the Grand Prize must be accepted as awarded
and cannot be substituted or transferred and has no cash surrender value, consents to
the use of his/her name, address (city and state), photographs, image, statements
regarding the Sweepstakes or any of the Prizes and/or voice, without further
remuneration, in connection with any publicity carried out by or on behalf of the
Sponsor with respect to the Sweepstakes in any media whatsoever, and releases the
Sponsor, its respective affiliates (including, without limitation, its parent,
sister and subsidiary companies), advertising and promotional agencies, and their
respective shareholders, directors, officers, employees and agents (collectively
the “Releasees”) from and against all liability in connection with the Sweepstakes
and/or the awarding and use of the Grand Prize.
RELEASE: The Sponsor and the Administrator do not assume any
responsibility and each entrant releases the Releasees from any and all claims,
actions, damages, demands and liabilities of whatever nature or kind arising out
of, or in connection with the entrant’s participation or attempted participation
in the Sweepstakes, including, without limitation the selection of the Winners and
the administration of the Sweepstakes. The Releasees are not responsible for (i)
the incorrect or inaccurate capture of entry information and entries that fail to
comply with the Official Rules; (ii) any loss, damage, or claims caused by an awarded
Prize or the Sweepstakes itself; or (iii) any failure of the website during the
Promotional Period, including any problems, human or technical, printing errors,
lost, delayed, garbled data or transmissions, omissions, interruptions, deletions,
defects or failures of any telephone or computer lines, technical malfunctions of
any computer on-line systems, servers, access providers, computer equipment, software,
failure of any e-mail or entry to be received on account of technical problems or
traffic congestion on the Internet or at any website, or any combination thereof
including any injury or damage to an entrant’s or any other person's computer related
to or resulting from downloading any material connected to the Sweepstakes, all of
which may affect a person’s ability to participate in the Sweepstakes. Entry
material/data that has been tampered with or altered is void. The sole liability
of Sponsor for an irregular UPC Code is limited to replacement with a free UPC Code,
while supplies last.
CONDITIONS OF ENTRY: By entering the Sweepstakes, entrants (i)
agree to read and abide by these Official Rules including all eligibility requirements,
and (ii) agree to be bound by the Official Rules and by the decisions of the Administrator,
made in their sole discretion, which shall be final and binding in all matters relating
to this Sweepstakes.
DISPUTES: If a dispute arises regarding who submitted an on-line
entry, the entry will be deemed to have been submitted by the authorized account holder
of the e-mail address provided at the time of entry. The authorized account holder is
defined as the natural person who is assigned an e-mail address by an Internet access
provider, on-line service provider, or other organization responsible for assigning
e-mail addresses for the domain associated with the submitted e-mail address.
GENERAL: The Sweepstakes are void where prohibited by law and is
subject to all applicable federal, state and municipal laws and regulations. Except
as expressly warranted herein, each Prize is provided “as is” without further warranty
of any kind. The Sponsor reserves the right to terminate, modify, or suspend the
Sweepstakes or to amend the Official Rules at any time and in any way, without prior
notice, for any reason whatsoever. Without limiting the foregoing, if for any reason
the Sweepstakes are not capable of running as originally planned, for example as a
result of tampering or infection by computer virus, the Sponsor reserves the right
to terminate the Sweepstakes and conduct a random draw from all previously received
eligible entries.
CONSENT TO USE PERSONAL INFORMATION: The Sponsor respects your
right to privacy. By entering the Sweepstakes electronically and voluntarily providing
your personal information (including, but not limited to e-mail address, first name,
last name, date of birth, mobile phone number, carrier/cell service provider, city,
state, zip code, and daytime phone number) (collectively “Registrant Information”)
you consent and agree to: (i) Sponsor’s collection and use of the Registrant
Information to administer this Sweepstakes; (ii) Sponsor’s use of your Registrant
Information to contact you to promote draws, interactive features and contests
similar to the Sweepstakes, promote opportunities to subscribe to Sponsor newsletters
and promotional clubs, notify you about programs and special events. Your consent to
Sponsor’s use of Registrant Information may be revoked at any time (without revoking
your participation in the Sweepstakes or impairing your chances of winning) by
sending an e-mail with the words “unsubscribe” in the subject line to
scotties@hawk.ca.
ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE
OPERATION OF THE SWEEPSTAKES IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND IF SUCH AN ATTEMPT
BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE
FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
GENERAL CONDITIONS: By participating in the Sweepstakes, participants agree
to be bound by and comply with these Official Rules. Sponsor assumes no responsibility for lost,
late, damaged, mutilated, misdirected, incomplete, altered, illegible or postage-due mail, UPC
Codes, requests or prize claims; computer bugs or viruses; failures in servers or other connections;
lost or interrupted or unavailable network, miscommunications, failed phone or hardware or software
transmission failure in loss; delayed or corrupted data transmissions; garbled or jumbled
transmissions or other errors of any kind, whether human, mechanical or electronic; or any injury
or damage to an entrant’s or any other person’s computer related to or resulting from participation
in the Sweepstakes. All entries become the sole property of Sponsor. Sponsor is not responsible for
electronic transmission errors resulting in omission, interruption, deletion, defect, delay in
operations or transmission, theft or destruction or unauthorized access to or alterations of entry
materials, or for technical, network, telephone equipment, electronic, computer, hardware or software
malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive visit
information by Sponsor or presenter on account of technical problems or traffic congestion on the
Internet or at any Web site or any combination thereof. If for any reason the Internet portion of
the program is not capable of running as planned, including infection by computer virus, bugs,
tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the
control of the Sponsor, which in Sponsor’s judgment, corrupt or affect the administration, security,
fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at its
sole discretion, to disqualify any individual who tampers with the entry process, and to cancel,
terminate, modify or suspend the Sweepstakes. Sponsor in its sole discretion may conduct the random
drawing from among all eligible entries received prior to such cancellation, termination,
modification or suspension of the Sweepstakes. Any UPC Code that is tampered with, illegible,
incomplete or blank (in whole or in part), forged, mutilated, or contains printing, production,
typographical, mechanical or other errors, or is not obtained legitimately, will be deemed void.
The sole liability of Sponsor for an irregular UPC Code is limited to replacement with a free UPC
Code, while supplies last. Participants (or their parent/legal guardian, if applicable), by
participating in this Sweepstakes, hereby waive and release, and agree to hold harmless the Sponsor,
its respective parents, subsidiaries, affiliates, distributors, advertising and promotion agencies
and all of their respective officers, directors, employees, representatives and agents, from and
against, any and all rights, claims and/or causes of action whatsoever that they may have, or which
may arise, against any of them for any liability for any matter, cause or thing whatsoever,
including but not limited to any injury, loss and/or damage, whether direct, compensatory, incidental
or consequential, to person (including death), or to property, arising in whole or in part, directly
or indirectly, from their acceptance, possession, use or misuse of the prize in the Sweepstakes,
or their participation in the Sweepstakes, or their participation in any Sweepstakes or prize
related activity. Winners (or their parent/legal guardian, if applicable) also further acknowledge
that Sponsor, its affiliates, subsidiaries, employees, officers, directors, and promotion and
advertising agencies have neither made, nor are in any manner responsible or liable for, any
warranty, representation or guarantee, express or implied, in fact or in law relative to any
prize or this Sweepstakes including but not limited to quality, condition or fitness for a
particular purpose. Acceptance of any prize shall constitute and signify the winner’s agreement
and consent that Sponsor may use the winner’s name, address (city, state), likeness, and/or
prize information for promotional purposes worldwide, in any media now known or later developed,
without limitation and without further payment or consideration, except where prohibited by law.
ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE
OPERATION OF THE SWEEPSTAKES IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND IF SUCH AN ATTEMPT
BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE
FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
